I determine the claims for damage caused by the collisions allowable
 
1st From Major Stevensons statement of Sep. 26th, it appears to have been, in substance altho motion forms, on impressment of the cars and engines of the Nashville & Chatt. R R Co. This makes the case as guarantor of the safety of the property.
2nd The cars and engines being ????? were under the control of its officers and the engineers &c were ??? the officers of the Co and not of the N&C R. R. Co. The later therefore would not be responsible for negligence.
